The Marriage/Partner Visa allows individuals to join or stay with their British or settled partner in the UK under Appendix FM. It covers both marriage and durable partner relationships. Applicants may apply from overseas or, in some cases, switch in-country.

  • Eligibility: The relationship must be genuine and subsisting, and both partners must intend to live together permanently in the UK.
  • Financial requirement: £29,000 annual minimum income (for new applications from 11 April 2024), with transitional rules for earlier applicants.
  • Accommodation: Proof of adequate accommodation without recourse to public funds is required.
  • English language: Level A1 CEFR or higher for first applications; higher levels apply for extensions and settlement.
  • Duration: Usually granted for 33 months (if applying overseas) or 30 months (if applying from inside the UK).

Purpose of the Visa

The Marriage/Partner Visa enables a British citizen, person settled in the UK, or someone with pre-settled status under Appendix EU to bring or stay with their partner in the UK. It applies to spouses, civil partners, and durable (unmarried) partners who can demonstrate a genuine and ongoing relationship.

Eligibility Requirements

  • Both partners must be aged 18 or over and free to marry or form a partnership recognised under UK law.
  • The relationship must be genuine, subsisting, and supported by ongoing contact and cohabitation evidence.
  • Partners must intend to live together permanently in the UK.
  • Applicants must meet the financial requirement: £29,000 per year (for new applications from 11 April 2024).
  • Applicants must meet the English language requirement at A1 CEFR (first application) or higher at later stages.
  • Proof of suitable accommodation in the UK without public funds is required.

Supporting Documents

  • Marriage certificate or proof of relationship (durable partnership evidence).
  • Proof of genuine and subsisting relationship – photos, correspondence, communication, and travel evidence.
  • Financial evidence – employment income, self-employment records, or savings held for 6 months or more.
  • English language test certificate (A1 or above from approved centre).
  • Proof of accommodation (tenancy agreement or property ownership).

Visa Duration and Conditions

If applying from overseas, the visa is normally granted for 33 months; if applying from within the UK, it is granted for 30 months. Extensions are possible leading to settlement (Indefinite Leave to Remain) after five years if requirements are met continuously.
